Daniel Genet is the founder and president of Tampa Mediation and is a Florida Supreme Court Certified Family Law Mediator in the Tampa Bay area with over 14 years of litigation and mediation experience in family law, civil disputes and personal injury matters. Mediation is a process where the mediator, acting in an impartial and neutral way, helps the parties reach an agreement. It gives the parties to a divorce an opportunity to divorce with dignity, civility and respect. It also gives parties in other civil matters an opportunity to maintain a continued working relationship and resolve their dispute efficiently. The mediator works to help keep the discussions focused on the interests of the parties and on creative solutions that benefit both sides. Even when cases are not resolved at mediation, the parties typically learn something of value and frequently resolve the case without having to go to trial. The goal of mediation is to help the parties reach an agreement that is acceptable to all of the parties. The parties know their situation better than anyone else and thus, are better equipped than the court to know the best solution. Mediation allows for a much more customized and creative solution than can typically be achieved by the Court. The Court has very limited time and is bound by the law in its decision-making. Some benefits of mediation services are as follows: Cost Effective. Mediation is much less expensive than litigation. Confidential. With limited exceptions, all of your mediation communications are protected. Private. Everything that happens in mediation is not public record like it is in court. Voluntary. You may stop the mediation at any time. Efficient. Mediation is much quicker than litigation. Non-Binding. You are not bound to anything until both sides agree. Informal. Mediation is more comfortable and relaxing than a courtroom. Control. The parties to a mediation participate and create the details of the agreement and tend to be happier with the results and more likely to comply. The parties are the decision makers in mediation. Respectful. Mediation is more likely to help maintain a healthy working relationship. Mediation is appropriate for parties that either do not have attorneys or are represented by attorneys. Frequently, mediation opens the door for the parties to communicate effectively in a safe environment, gives the parties an opportunity to better understand each other's interests, needs and wants, gives the parties an opportunity to brainstorm and sets the stage for healthier communications in the future. The mediator does not make decisions for you but will help you reach your own agreements that are more thoughtful and workable than an order imposed upon you by the Court. The parties are in complete control of creating the final agreement.
